Waco Roll-Offs Rental Agreement

I. SERVICE & PRICING SCHEDULE

Base Rental Includes: Delivery, Pickup, Disposal (up to included tonnage), and 24 Hours of rental time.

Bin Size:

• 11-Yard: $289.00 (Includes 1.5 tons) | Concrete/Brick Surcharge: $75
• 15-Yard: $329.00 (Includes 2.0 tons) | Concrete/Brick Surcharge: $100
• 18-Yard: $369.00 (Includes 2.5 tons) | Concrete/Brick Surcharge: $125

Clean Load Rate: A load that is 100% one clean material - clean concrete, clean dirt, or clean wood and brush, as defined in Section 8 - is discounted below the base rental price above and includes a full 7 tons in place of the allowance listed for that bin. Seven tons is also the maximum weight we can haul, so a clean load carries the largest allowance we are able to offer. Clean concrete and clean dirt can only be hauled in the 11-Yard bin.

Additional Fees & Overages:

• Rental Extension: $10.00 per day after the initial 24 hours, reduced to $5.00 per day from the fifteenth day of the rental onward.
• Standard Weight Overage: $0.05 per pound over the included limit.
• Concrete/Brick Weight Overage: $0.08 per pound (applies to total weight if mixed or if heavy material limit exceeded).
• Dry-Run / Trip Fee: $75.00 (Charged if bin is inaccessible, blocked, or overfilled upon pickup).
• Dump & Return: the base rental price for that bin less $10.00, carrying the same material discount or surcharge a first load would carry, plus the same distance fee the original booking carried, if any. Arranged by phone or text, not on the website. See Section 21.
• Overnight Delivery Fee: $100.00 per dumpster for drop-offs scheduled between 10:00 PM and 5:00 AM, covering the overnight drop-off and the overnight pickup. See Section 23.

II. TERMS AND CONDITIONS

1. Rental Period
The base rental fee includes use of the dumpster for 24 hours. Any rental period extending beyond 24 hours will incur a fee of $10.00 per day through the fourteenth day of the rental, and $5.00 per day from the fifteenth day onward. Rentals of up to 30 days may be booked on the website; a longer term may be arranged by calling or texting (254) 300-1019. Where a Customer needs to extend a rental already in progress, Customer must notify Waco Roll-Offs 24 hours in advance, and the additional days are charged at the rates above.

2. Weight Limitations & Heavy Materials

• Maximum Capacity: The total weight of contents inside of the dumpster must not exceed 7 tons for safety and transport reasons.
• Concrete/Brick: If the landfill or transfer station detects concrete, brick, dirt, or rock, the "Concrete/Brick Surcharge" listed above will apply immediately. If the load exceeds the included tonnage with these materials present, the overage rate is $0.08 per pound (instead of the standard $0.05 per pound).

3. Loading & Overfill (Strictly Enforced)

• Level Loads Only: Debris MUST NOT extend above the top rail or sides of the dumpster. We transport using a truck and trailer system; for safety on Texas highways, we cannot tarp or haul uneven or overfilled loads.
• Refusal of Service: If the driver determines the bin is filled over the sides or exceeds the 7-ton safety limit, the bin will not be hauled. A $75 Dry-Run Fee will be charged, and the customer will be responsible for offloading material to bring the bin into compliance before we return.

4. Access & Ground Conditions
The Customer agrees to provide unobstructed access to the delivery site. If the driver arrives for delivery or pickup and is unable to perform the service due to locked gates, blocked driveways, or other obstructions, a $75 Dry-Run Fee will be charged.
Warning: While our truck and trailer system is lighter than large commercial waste trucks, heavy bins can still cause damage to driveways, sidewalks, or lawns. Waco Roll-Offs is not liable for damage to pavement or underground utilities (sprinklers, septic, etc.) caused by the weight of the bin or the truck.

5. Prohibited Items
The following items are strictly prohibited. Finding these items in the dumpster will result in additional fines and/or the immediate return of the debris to the customer at the customer’s expense:

• Hazardous waste, chemicals, pesticides, or solvents.
• Liquids of any kind (paint, oil, gas). Dried latex paint is acceptable.
• Tires, batteries, or appliances containing Freon (unless pre-approved).
• Asbestos or bio-medical waste.

6. Payment & Authorization
Base rental fees are charged in full at the time of booking. Customer explicitly authorizes Waco Roll-Offs to charge the credit card on file for any additional fees incurred after the dumpster is weighed and tipped, including: tonnage overages, daily rental extensions, dry-run fees, or prohibited item fines.

7. Cancellation & Rescheduling

• Cancellations: Cancellations made more than 24 hours prior to the scheduled delivery time are subject to a 10% service fee. Cancellations are not permitted within 24 hours of the scheduled delivery time; the full base rental fee will apply.
• Rescheduling: Requests to reschedule made more than 24 hours prior to the scheduled delivery time will be processed at no charge. Requests to reschedule made within 24 hours of the scheduled delivery time are subject to a 10% rescheduling fee.

8. Clean Material Definitions
"Clean" means the load consists 100% of that specific material with NO trash, plastic, or other debris mixed in. A load meeting one of these definitions qualifies for the Clean Load Rate in Section I: a discount off the base rental price and an included allowance of 7 tons rather than the tonnage listed for the bin. A load that does not meet the definition is priced as a standard or Mixed / Heavy load, whichever applies, at the allowance for that bin. Painted, stained, or pressure-treated lumber does not qualify as Clean Wood.

• Clean Concrete: Concrete, rock, brick, or block only.
• Clean Dirt: Soil, sand, or clay only.
• Clean Wood: Tree limbs, brush, or unpainted lumber.
• Mixed / Heavy Load: Any load containing trash mixed with concrete, dirt, or heavy debris is considered a Mixed Load and will be charged the heavy material/concrete surcharge.

9. Indemnification and Release of Liability
Customer agrees to accept full responsibility for the equipment while it is on their property or in their possession. Customer agrees to indemnify, defend, and hold harmless Waco Roll-Offs, its owners, employees, and agents from any and all claims, damages, suits, penalties, fines, or liabilities for injury or death to persons, or loss or damage to property arising out of Customer’s use, loading, operation, or possession of the dumpster.

10. Equipment Care and Damage
Customer assumes full responsibility for the care of the dumpster while it is in their possession. Customer agrees to pay for any damage to the dumpster beyond normal wear and tear, including but not limited to damage caused by fire, heavy machinery (e.g., excavators, skid steers), corrosive materials, or improper loading.

11. Governing Law and Severability
This Agreement shall be governed by the laws of the State of Texas. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12. Photographs and Records of Service
Waco Roll-Offs may photograph the dumpster, its contents, and its placement at delivery and at pickup. These photographs are kept as a record of the condition of the site and of the load, and may be used to document weight, overfilling, prohibited items, access problems, or the condition of the property in the event of a dispute.

13. Disposal of Contents
All material placed in the dumpster becomes the property of Waco Roll-Offs at the time of pickup and is transported directly to a licensed disposal facility. Customer is responsible for removing anything they intend to keep before pickup. Once a load has left the property we cannot retrieve, search for, or return items from it, and Waco Roll-Offs is not liable for the value of anything left in the bin.

14. Authority to Order Service
By booking, Customer confirms they are at least 18 years of age and are either the owner of the delivery property or have the owner’s permission to place a dumpster there. A Customer booking as a tenant, contractor, or agent confirms they have authority to accept these terms on behalf of the property owner. Customer is responsible for any claim arising from placement made without that authority.

15. Placement, Permits, and Private Restrictions
Customer selects the placement location and is responsible for confirming that placement is permitted. If the dumpster is placed on a public street, alley, or right-of-way, Customer is responsible for obtaining any permit required by the City of Waco or other authority, and for any fine issued for placement without one. Customer is likewise responsible for compliance with any homeowners association, private road, or landlord restriction that applies to the property.

16. Scheduling, Service Days, and Delivery Windows
Bookings must be placed at least 12 hours before the requested drop-off time. We deliver Monday through Saturday; we are closed on Sundays, and Wednesdays are morning drop-offs only. Delivery and pickup times are estimates rather than guarantees. We will make reasonable efforts to arrive within the scheduled window and will contact Customer if we are unable to.

17. Delays Beyond Our Control
Waco Roll-Offs is not liable for any delay or failure to perform caused by conditions outside our reasonable control, including severe weather, flooding, road closures, closure of a landfill or transfer station, mechanical breakdown, accident, labor disruption, or acts of government. Where such a delay occurs we will reschedule service at the earliest time available at no additional charge, or refund the base rental fee if the service cannot be performed at all.

18. Limitation of Liability
To the fullest extent permitted by Texas law, the total liability of Waco Roll-Offs arising out of or relating to this Agreement, regardless of the cause of action, will not exceed the total amount Customer paid for the rental giving rise to the claim. Waco Roll-Offs is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, delay costs, or loss of use, even if advised that such damages were possible. Nothing in this section limits any liability that cannot be limited under Texas law.

19. Billing, Weight Records, and Disputed Charges
Additional fees are charged to the card on file after the dumpster is weighed and tipped. Customer may request a copy of the scale ticket supporting any weight-based charge, and Waco Roll-Offs will provide it. Customer agrees to raise any billing dispute with Waco Roll-Offs directly and in writing within 10 days of the charge, before initiating a chargeback with their card issuer. If the card on file is declined, Customer remains responsible for the amount owed and agrees to pay it within 10 days of notice.

20. Venue and Attorney’s Fees
Any dispute arising out of or relating to this Agreement will be brought exclusively in the state or federal courts sitting in McLennan County, Texas, and both parties consent to that venue. In any action brought to enforce this Agreement, the prevailing party is entitled to recover its reasonable attorney’s fees and costs.

21. Dump & Return Service
A dump & return is where Customer fills the dumpster and needs it emptied without ending the rental: we haul the load to the landfill, empty the dumpster, and bring the same dumpster back to the same address so Customer can keep loading. A dump & return is arranged by calling or texting (254) 300-1019 and cannot be booked on the website.

Each dump & return is charged at the base rental price for that bin size less $10.00: $279.00 for the 11-Yard, $319.00 for the 15-Yard, and $359.00 for the 18-Yard. The material pricing a first load would carry applies to a dump & return as well. A load qualifying for the Clean Load Rate takes that discount too, bringing it to $204.00 for the 11-Yard, $219.00 for the 15-Yard and $234.00 for the 18-Yard; a Mixed / Heavy load carries the Concrete/Brick Surcharge for that bin. If the original booking carried a distance fee, the same distance fee applies to each dump & return, because it is the same drive.

A dump & return does not change the length of the rental. The rental runs for the period Customer booked and is charged for that period: a seven-day rental with a dump & return on the second day is still a seven-day rental. The extension rates in Section 1 apply only if Customer keeps the dumpster past the period booked.

Every load hauled carries the included tonnage allowance for that bin in its own right, so a dump & return does not draw down the allowance already used. The weight limits in Section 2 and the overage rates in Section I are applied to each load separately, and each load is weighed and ticketed on its own.

22. Rush Bookings
Notwithstanding the 12-hour notice in Section 16, Waco Roll-Offs may agree by phone or text to deliver sooner by approving a rush booking for the phone number Customer provides. An approval allows one booking with less than 12 hours’ notice for that phone number, is valid only on the day it is given, and ends once that booking is paid. A rush booking is priced the same as any other booking, and every other term of this Agreement applies to it. Because a rush booking is placed within 24 hours of delivery, the cancellation and rescheduling terms in Section 7 for changes made within 24 hours of the scheduled delivery time apply from the moment it is booked.

23. Requested Times and Overnight Deliveries
Notwithstanding the delivery days and windows in Section 16, Customer may request a drop-off at any hour on any day, including Sundays and times Waco Roll-Offs has marked closed, but not a time already taken by another booking. A drop-off outside our regular delivery windows, or at a time we have marked closed, is accepted only if Waco Roll-Offs approves it by phone or text for the phone number Customer provides, on the same terms as a rush booking in Section 22: an approval allows one booking, is valid only on the day it is given, and ends once that booking is paid. A request made under Section 22 or this Section is not a booking and does not guarantee approval: Waco Roll-Offs may decline it or offer a different time, and nothing is charged unless Customer completes and pays for a booking. The rental period runs from the drop-off time as it does for any other booking, so pickup falls due at the same hour at the end of the rental period unless Waco Roll-Offs and Customer agree on another time. A drop-off scheduled between 10:00 PM and 5:00 AM therefore carries an Overnight Delivery Fee of $100.00 per dumpster, which covers both the overnight drop-off and the overnight pickup. It is shown before checkout, charged with the booking, and is not reduced if the pickup is later moved to another time by agreement. Customer is responsible for safe access to the placement area at the scheduled time, including adequate lighting after dark, and the Dry-Run / Trip Fee in Section I applies if the dumpster cannot be placed or collected for lack of safe access.

III. ACCEPTANCE

By signing below, I acknowledge that I have read and agree to the terms and conditions outlined above. I authorize Waco Roll-Offs to charge my credit card for any overages or fees as described.
